there are two kind of justices on the Supreme Court

One kind, believes in the rule of law, the Constitution and checks & Balances:

"The Constitution is best preserved by reliance on standards tested over time and insulated from the pressures of the moment," Justice Kennedy

The other kind, believes in the supreme Executive. A "King" George if you will:

"It is not clear where the court derives the authority — or the audacity — to contradict [Congress and the executive branch]" Justice Scalia

Thankfully, the former ruled the day. For now..
